Terms of Service

These Terms of Service ("Agreement") govern the use of photography services provided by Bieger Media, a rodeo photography company. By booking a session or purchasing any products, you agree to these terms.

1. Services Offered

Bieger Media specializes in providing photography services for rodeo events. These services include, but are not limited to:

Event photography (rodeos, horse shows, etc.)
Digital downloads of event photos
Print and product orders
Custom photo packages

2. Booking and Payment

Booking: To book a photography session, you must provide the event details (date, location, etc.) and a valid email address for communication.
Payment: Full payment is required at the time of booking to confirm your session unless otherwise agreed upon. Accepted payment methods include credit/debit cards, PayPal.
Pricing: Prices for photography services, prints, and digital products are listed on the gallery or included within your services. These prices are subject to change without notice.

3. Cancellations and Rescheduling

Cancellations: If you need to cancel or reschedule, please notify us at least 5 days before the scheduled session. Cancellations made within 5 days of the session are subject to a [25%] cancellation fee.
Rescheduling: If you reschedule a session with more than 3 days notice, we will do our best to accommodate your new date. Rescheduling within 2 days may incur a fee, subject to availability.

4. Photo Usage

Personal Use: Upon receiving your photos, you have the right to print and use them for personal, non-commercial purposes only. This includes using the photos on personal social media accounts, with credit to Bieger Media if required.
Commercial Use: For commercial use (advertising, promotional materials, etc.), a separate commercial license must be purchased. Contact us for details on commercial licensing.
Copyright: All images are copyrighted by Bieger Media unless otherwise stated. The photographer retains ownership of all images taken during the event.

5. Delivery of Images

Digital Delivery: Digital images will be delivered via a private online gallery or through email. Links to download images are typically available within 5 days after the event.
Prints: Physical prints will be processed and shipped according to the package selected during booking. Please allow 2-3 weeks for printing and delivery.

6. Privacy and Image Rights

Model Release: By booking a session with Bieger Media, you grant permission for Bieger Media to use the images taken during the session for promotional purposes (e.g., on our website, social media, or marketing materials) unless otherwise requested in writing.
Privacy: We will not share your personal information with third parties without your consent unless required by law.

7. Liability and Indemnity

Limitation of Liability: Bieger Media is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the photographs.
Indemnity: You agree to indemnify and hold harmless Bieger Media from any claims, damages, or losses arising from your use of our services or images, including those from third-party claims.

8. Quality Assurance and Refunds

Quality Assurance: We strive to provide the highest quality images. If for any reason the quality of your images is compromised due to technical issues on our end (e.g., camera malfunction), we will offer a re-shoot or a full refund.
Refunds: Due to the nature of digital and custom photo products, all sales are final. We do not offer refunds for digital images once the product has been delivered. If there is an issue with your prints (e.g., damage during shipping), please contact us within 5 days of receiving the product.

9. Force Majeure

Bieger Media will not be held responsible for failure to perform under this Agreement if such failure is caused by circumstances beyond our control, such as, but not limited to, natural disasters, accidents, or government restrictions.

10. Amendments to Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page, and the updated date will be reflected at the top of this document.

11. Governing Law

This Agreement will be governed by and construed in accordance with the laws of Georgia/United States. Any disputes related to this Agreement will be resolved in the courts of Canton, Georgia.
